Bill Bowers, officiating.

Burial will be in Butcher Cemetery near here under the direction of Hathaway of Wheatland. Mrs. Shelten died Thursday in St. John's Regional Health Center, Springfield, after a long illness. She was a member of Weaubleau Church of God and was a homemaker.

Survivors include a son, Lonnie, Weaubleau; a brother, Wilbur Bishop, Quincy; a sister. Fay Shelten, Humans-ville; and two grandchildren; The family will be at the funeral home after 7 p.m. Elsie Carstanjen Elsie Carstanjen, 77, Springfield, died Wednesday in Springfield General Osteopathic Hospital after a long illness. Mrs. Carstanjen was a member of Worldwide Church of God.

Survivors include three daughters, Mrs. Ruth Pasini, Elmhurst, 111., Gail Hamilton, San Jose, and Inga Verla, Portland, six grandchildren; and a greatgrandchild. Memorial services will be at 4 p.m. today in Greenlawn North with George Meeker Grant Burnett Grant Burnett, 74, Springfield, died at 4 p.m. Thursday in Cox Medical Center after a long illness.

Mr. Burnett had been a Springfield resident most of his life and worked several years for Wheat Electric Company and Springfield Electric Company. He had also worked for Electric Motor Service as a repairman. Survivors include three daughters, Mrs. Carol Dar-lene Smith, Springfield, Mrs.

Linda Kay Manuel, Bolivar, and Mrs. Beverly Jean Deav-er, state of California; a son, William Republic; five grandchildren; and four great-grandchildren. Ralph Thieme will announce services. The family will be at the funeral home from 3 to p.m. Sunday.

Marvin Davis MONETT Services for Marvin Davis, 80, Wichita, will be at noon Saturday in Bennett-Wormington Chapel with the Rev. Wini-ford Davis officiating. Burial will be in Bethel Cemetery near here. Mr. Davis died at 2:20 a.m.

Friday in St. John's Regional Health Center, Springfield, after suffering a heart attack on Thanksgiving Day. He was a retired carpenter courts previously had required the city to pay the amount the board specified. However, Missourians' approval of the Hancock Amendment changed all that, wrote Judge Andrew Jackson Higgins for the court's majority, which also included Judges Robert Donnelly, Robert Seiler and Warren Welliver. "(The Hancock Amendment) is explicit in its prohibition against state agencies requiring increased activity of cities or other political sions without an attendant state appropriation to cover the increased cost," Higgins wrote.

Since the police board is created by a state law, it is a state agency and the city no longer is required to abide by its dictates. In his first dissent, newly appointed Judge George Gunn wrote for himself, Judge Albert Rendlen and Special Judge James A. Finch that the majority's decision tears, down the protection of the St. Louis Police Department. "Under today's holding the Board of Aldermen for the first time will assert its influence over the St.

Louis Police Board and tear away the protective abatis that was established over 120 years ago to prevent the aldermen's intrusion upon the police board's authority over budgetary affairs," he said. By Keith White Our Capital Bureau JEFFERSON If a state agency requires a local government to do anything that requires Increased spending, the state must provide the money, the Missouri Supreme Court ruled Friday. The case in question was a funding dispute between the St. Louis Board of Police Commissioners and the city of St. Louis, but the opinion may have a far-reaching impact.

It would appear, for example, that the court's 4-3 opinion could bolster Greene County officials' arguments that the county is not required to pro- vide office space for the public defender's office. Circuit court budgets that counties now must pay in full also could be affected by the decision. Friday's opinion was another case where the court broadened the impact of the Hancock Amendment, the constitutional amendment limiting government taxing and spending. Voters adopted the tax-lid in 1980. St.

Louis' dispute arose when the Board of Police Commissioners took -the city to court because the city would not pay a nearly $3.1 million increase in the board's budget for the current fiscal year. That board was set up to insulate the St. Louis Police Department from the pressures of local politics, and this result with the Hancock Amendment does not ring true to me. Gunn said. Also Friday, Justices upheld the conviction of Osage Beach fireworks seller Leo Burnau and the $10 fine he was ordered to pay for selling fireworks at retail before state law permitted him to in 1981.

Burnau was arrested on June 9, 1981, by a Camden County deputy sheriff who purchased $5-30 of fireworks from his stand. The deputy testified that Burnau told her to say the fireworks were purchased wholesale and that 'various signs around the stand told buyers they were agreeing to buy them wholesale. State law prohibits the retail sale of fireworks until June 20 each year. For violating that law, Bumau was fined $10. Burnau appealed his conviction, arguing the law is unconstitutionally vague because it does not define what is retail.

"(The law) is so vague that men of common intelligence must necessarily guess at its meaning and differ as to its application," his attorney wrote. Judge Higgins, writing this time for a unanimous court, said the court could find no confusion about the meaning of "retail." Sylvia Martin LICKING Services for Sylvia V. Martin, 86. She was a former vice president of the board of directors of Freeburg Senior Citizens Homes and a member and former president of Freeburg Senior Citizens Club- She was a member of Holy Family Catholic Church and St. Ann's Sodality. MittieRose Mittie D. Rose, 103, Springfield, died at 5:30 a.m. Friday in Springfield Health Care Center after a long illness. Mrs. Rose, born in Virginia, was a Springfield resident most of her life and was a member of Calvary Temple Assembly of God.

Surviving is a daughter, Mrs. Lucille Rainey, Springfield, Klingner Mortuary will announce services. will be in Marshfield Cemetery. Mr. Hamby died Wednesday morning near Madison, when the tractor-trailer he was driving missed a curve in dense fog.

Burks worked with her husband in Burks Machinery Company and was a member of South Street Christian Church. The evacuees were kept away from their homes for about six hours Iter the 9:30 a.m. accident while firemen used foam and water to wash the spilled fuel away, Police Chief Stan Spadonl said.

The driver of the truck, an employee of Temmen Transport was not injured. Five workers at the scene were treated for minor burns suffered when they came in contact with the gasoline, authorities said. "When it turned over, it turned over on its side into a ditch. We had a considerable seepage of fuel I would say at least several hundred gallons," Spadoni said. The eastbound tanker, fully loaded with 8,000 gallons of fuel, overturned on Missouri 72 just inside the Rolla city limits, Spadonl said.

The accident forced evacuation of a trailer park and several homes within 1,000 feet of the scene, the chief.said. The Missouri Highway Patrol said Charles O. Withem, 70, of Benton, was dead on arrival Friday at Barton County Hospital in Lamar following a one-vehicle accident near Jasper. Troopers said Withem was riding in a car driven by his sister, Faye Belle Jones, 67, also of Benton. They said she met oncoming traffic, pulled too far to the right, and struck a bridge abutment on Missouri 126 three miles north of Jasper at 11:45 a.m.

Friday. The driver was taken to the Lamar hospital with a right leg fracture, cuts and bruises. She was transferred to St. John's Regional Health Center in Springfield, where she was reported to be in stable condition following surgery Friday evening. Earline Taylor, 51, of Clever, was injured at 1:15 p.m.

Friday when she lost control of her car as she attempted to miss a dog. Troopers said her auto crossed the center line' of U.S. Highway 160 two miles south of Springfield and struck another car. Troopers said Ms. Taylor was taken to Cox Medical Center with a broken right arm.

However, hospital attendants had no record of her being treated there. The other car was driven by Steve D. Perkins, 27, of, Springfield. Meanwhile, Dolphina P. Andrews, 32, of Lake Ozark, was taken to Lake of the Ozarks General Hospital in Osage Beach with undetermined Injuries suffered In an accident at 10:.10 a.m.

Troopers said her car began skidding on wet pavement, went off the road, down an embankment and brothers, Carl and Leota Mat-tison, both of Mountain View, and Bertis and Turner Matti-son, both of Summersville; four sisters, Mrs. Olive Plank, Mountain View, Mrs. Bonnie Evans, Wichita, Mrs. Electa Martin, Bothell, and Mrs. Betty Porter, Teresita; and four grandchildren.

The family will be at the funeral home from 2 to 4 p.m. Sunday. Harold Laverty CASSVILLE Graveside services for Harold C. Laver- ty, 66, Cassville, will be at 2 p.m. Tuesday in Fields Ceme- tery east of Shell Knob with the Rev.

Hunter was listed In fair condition Friday at St. John's Regional Health Center In Springfield. Troopers said Ms. Hunter's vehicle apparently was traveling south at an excessive rate of speed and rn off the highway. Earlier Thursday evenings four people were Injured in another accident on U.S.

65 about eight miles south of Ozark, troopers reported. Officers said a northbound car driven by Bruce C. Maples, 87, of Ozark, entered the southbound lane and struck vehicles driven by Lawrence J. Gill, 66, of Highlandville, and Francis M. Under.

6 1 of Forsyth. Maples was listed In satisfactory condition at St. John's in Springfield with cuts to the head and left hand. His wife, Maude, 81, was treated at St. John's and Under suffered bruises and wag treated at St.

John's and released. His mother. Louise F. Smallberger. 93, was listed In satisfactory condition Friday at the hospital with a finger laceration.
