2B Saturday, September 30, 1989 OZARKS The News-Leade ParkviewFive more football players join Parkview lawsuit over alleged drug use Schwyhart Teen-ager pleads guilty to 2nd robbery FROM PAGE 18 Springfield. Saying people in southern Stone County are afraid of Schwyhart, Rundel asked McGuire to assess a 30-year sentence to run consecutively to the federal charge. Schwyhart's attorneys, Richard Bender and Devon Sherwood, and Rundel told the judge the woman was not hurt. Schwyhart asked about any medical problems before he left her bound. He allowed her to tie one hand and he tied the other.

She was able to free herself before Schwyhart was out of the driveway, the lawyers said. Schwyhart has an extensive juvenile record, Bender said, but the two robberies were his first involvement with the adult system. The youth was certified to be charged as an adult in federal and circuit court Speaking on his own behalf, Schwyhart said he thought the reason people were afraid of him involved his family's background, not because of what he has done. Crable also said he didn't think it was right for his son to be kept in the school Office from 8:45 a.m. to 1:30 p.ra.

during Monday's investigation without being allowed to contact his parents or attorney. Aaron Alexander and Scott Blackington said they thought the pills would enhance their performance on the football field. "I knew I was not taking speed," Alexander said, although he "didn't really ask" what the pills were. Blackington said he knew he was taking caffeine pills, but had hoped they would help him play better in case college scouts were watching. "I was hoping to get a scholarship through football," he said.

Asked what they were doing while away from school, Alexander and Blackington said they were studying "a little bit" Scott said he was playing a lot of basketball and Aaron was working on his Jeep. Marilyn Alexander, Aaron's mother, said she's upset not only about the suspension from school but also the suspension from school-related activities. It means her son can't work because his job is part of the school's Cooperative Occupational Education program. Barrett Former state court commissioner dies FROM PAGE 18 joined the state's highest court in 1964. "It's been a grand experience," Higgins said of his 25-year friendship with Barrett "His personality was infectious and his love of the law was contagious.

He was a genuine person. He had no pretense about him. He knew and liked and respected people." Barrett is survived by two daughters, Carol Sarver of Raytown and Mary Helen Barrett of Sonoma, three grandchildren; and four great-grandchildren. Services are scheduled for 2 pm. Sunday in Freeman Chapel in Jefferson City.

Graveside services and burial will be at 2 p.m. Monday; at Maple Park Cemetery in Spring-Geld. Friends may call from noon until 2 p.m. Sunday at Freeman Mortuary. Memorial contributions may be sent to the Paul W.

CourtWillow Springs man sentenced FROM PAGE IB DeBarmore, 47, of Riverside, was named with Summerfield on a four-count federal grand jury indictment issued March 17. He was sentenced Friday to five years in prison for conspiracy to manufacture methamphetamine. That sentence, also from Clark, was in downward departure from the sentencing guidelines.

The judge noted DeBarmore 8 cooperation with the government in its investigation of the lab. DeBarmore "has placed himself and his family in jeopardy by cooperating in this case, Clark said. DeBarmore must report to U.S. Marshals to begin his sentence on Oct 23, Clark ordered. Summerfield will receive credit for 196 days he's spent in jail since his arrest In other federal court action Friday: Four defendants charged in an alleged conspiracy to manufacture and distribute amphetamine entered not guilty pleas during arraignments, joining two other co-defendants who have also pleaded not guilty in the case.

Charles Gerard Fields, 33, Southwest City; Kenneth Franklin Hib- bert, 30, Fair Grove; Candice Ann Highfill, 34, Springfield; and Kenneth Dale Wolfenbarger, 35, Wyandotte, entered their pleas in hearings before U.S. Magistrate James C. England. Two other defendants Kathy Marie Anderson, 28, Springfield; and Jimmy Dean Lawson, 34, who lists addresses in Fair Grove and Joplin pleaded not guilty at separate hearings earlier this week. Dates for their next court appearances have not been scheduled.

Anderson and Wolfenbarger are free on $25,000 unsecured bond. The other four defendants are being held without bond pending trial The six defendants were named on an eight-count federal grand jury indictment issued Sept 12. The charges stem from an Aug. 25 raid at Hibbert's home near Fair Grove and an Aug. 24 search at the Coach House Inn in Springfield.

Several weapons and quantities of chemicals were confiscated in the Fair Grove raid; about 42 grams of methamphetamine, a shotgun and a revolver were seized during the motel search, officials said. They found the teen-ager's body in the road under the bridge and called an ambulance. He was pronounced dead at 8:56 pjn. He is survived by his parents, Don and JoAnne, and younger brother, Kenneth.

Crites told reporters that the students knew they were not taking speed. There is nothing illegal about taking caffeine, he said, adding that football coaches give out other legal drugs such as stomach antacids to help with cramps. "These are children," he said.

"The word 'speed' was mentioned. It's bravado." In addition, the lawsuit charges the district with selective punishment because officials did not discipline other students alleged to have had pills referred to as "speed." All seven are prohibited from participating in extracurricular activities for 28 calendar days starting last Tuesday. Crable received the 10-day suspension, Ellis said, although he declined under federal privacy laws to say why. But Ellis said Crable's offense "was obviously worse" than the other students. Sam Crable, Fred's father, said the longer suspension for his son was for distributing pills to other players.

He said his son sold two or three dollar's worth of pills and, gave away the rest, and no more than 15 or 20 pills in all were involved. Sam Crable said Fred had ordered the pills from an advertisement in a weight-lifting magazine last spring hoping they would provide a stimulant to help heal an elbow he'd hurt while pole vaulting. "It was a caffeine pill," he said, adding that the suspensions were "an extreme penalty for a minor infraction." South. McCARTY, Bruce and Janet (Friend), 1194 E. Evans, a boy, 10:55 a.m.

He said school officials don't know what substance the students took, but the youths suspended were the ones who thought they had purchased or been given amphetamines or speed. Hagerty said it is just as serious to take a substance that is purported to be an illegal drug, citing a state law against imitation drugs.

If students get used to taking something that is not really an illegal drug and some day they take the real thing, "they could wind up dead instead of suspended," he said. Hagerty said five of the students remain suspended from school. He said the two Fischers voluntarily went through a drug and alcohol assessment process which made them eligible to have their suspension from class reduced to three days. They were permitted to return to school Friday, he said. Six of the students were suspended from classes Tuesday for six school days and another student was suspended for 10 days, Ellis FORGEY, Larry and Frankie (Bowers), 316 E.
