OZARKS MISSOURI The News-Leader Missouri agencies musS cut more from budgets 2B Friday. September 6, 1991 Court saps stretched state funds; officials plan to challenge judge sending payments when the spending to-'. tailed $150 million in May, he said. The state is challenging Clark's order to the 8th U.S. Circuit Court of Appeals in St Louis, and wants a quick hearing, Moody said.

However, he said the state is bracing lose the money if the appeals court orders the payments. Court-ordered desegregation payments are sliced off the top of Missouri's budget, Bemoaning the rising costs, Moody "This isn't a bottomless pit we are dealing -with in terms of revenue." However, he said, "We cannot ignore the court order. This is an unplanned thing." share of the costs. Ashcroft had previously cut or withheld $216.3 million from Missouri's $8.9 billion budget to avoid a deficit. He blamed sluggish revenues, the national recession and increased federal requirements for Medicaid spending.

An average of 12 percent of planned agency spending was withheld, although education absorbed smaller percentages 5 percent for higher education and 3 percent for elementary and secondary education. Those actions, announced on the eve of the new fiscal year which started July 1, led to more than 500 layoffs in the Department of Mental Health and program cuts and spending squeezes elsewhere. Moody said the new withholdings would affect all agencies. But he said public schools and higher education would be "hit real hard" by the new actions. The round of additional withholdings was prompted by a recent order from U.S.

District Judge Russell Clark, which increased the state's obligations in the long-running desegregation case, Moody said. Moody said the state previously believed its Kansas City desegregation spending for capital projects would be limited to about $150 million through this fiscal year because of a prior court order. It stopped memorandum distributed Thursday. Gov. John Ashcroft's spokesman, Bob Ferguson, said department heads had been told to quickly come up with plans for reducing their spending.

"We will look at the plans and decide what to do next," Ferguson said. Henry Rizzo, recently released from federal prison, said Thursday he will seek re-election to the Missouri House next year, although he likely will face a colleague in the Democratic primary. The Kansas City lawmaker began serving a three-month misdemeanor sentence on July 30 after entering a plea in a check-kiting case. He began his sentence at the minimum-security federal prison in Leavenworth, Kan. Rizzo, 38, was transferred Aug. 28 from the Leavenworth facility to a federal halfway house in Kansas City, where he is to remain until Oct.

28. Then, he is to be on supervised release for one year, Joseph Brandenburg, deputy chief U.S. probation officer in Kansas City, said Thursday. Rizzo entered an Alford plea in March to being an accessory after the fact to check-kiting. The charge involved floating checks between banks writing bad checks on one account to cover shortages in another.

Under an Alford plea, a defendant doesn't admit guilt, but acknowledges there's enough evidence for conviction. Rizzo was indicted in November 1990 on 16 counts of check-kiting and one count of felony conspiracy. Rizzo may leave the halfway house for a job, but must return at the end of the work day and spend his weekends there, Brandenburg said. "He remains legally in federal custody," he said. Rizzo said he didn't consider his political career to be over.

"Absolutely, I will seek re-election," he said. A proposal by the House Apportionment Commission puts Rizzo in the same district as Rep. Ronnie DePasco, D-Kansas City, a longtime colleague.
